Terms of Service

Please read this document carefully. These Terms of Service have been in effect since the date of 16.04.2025 and apply to all Bialto Users, regardless of their geographic location.

The use of this website and the associated services is subject to the laws of Portugal, and it is the User’s responsibility to comply with the laws of their own country if they differ from those applicable in Portugal.

Applicable Law and Jurisdiction

This website is operated by Bialto and is subject to the laws of Portugal. For all disputes arising from the use of this website or the associated services, only Portuguese law shall apply. The competent forum for all disputes related to the use of this website is Lisbon, Portugal, unless otherwise provided by mandatory legislation.

User Responsibility for Compliance with Local Laws and International Use

Users from other countries acknowledge that they are responsible for complying with the local laws and regulations of their respective country. It is the User’s responsibility to ensure that their use of the website and the associated services complies with the applicable national or regional laws, particularly with regard to the protection of personal data, taxation, customs regulations, and other legal provisions. Bialto provides its services to users from different countries, aware that the laws relating to online transactions, auctions, and consumer protection may vary according to the User’s country of residence.

Customs Duties and Taxes

For buyers outside Portugal, additional customs duties and taxes may apply, in addition to the purchase prices. It is the buyer’s responsibility to inform themselves about the import regulations and additional costs in their country. Bialto is not responsible for any additional duties or taxes charged during international shipping.

If a User accesses from a country where access to or use of this website is subject to special restrictions, Bialto is not responsible for any legal consequences arising from such use. The responsibility for complying with the laws and regulations of the User’s country of origin lies solely with the User.


1. DEFINITION OF TERMS

Within the scope of these Terms of Service (hereinafter “TOS”), the identified terms shall be interpreted as follows:


2. INTRODUCTION

2.1.

The Bialto.com Service is governed by these Terms of Service (hereinafter, TOS), as well as by the respective Appendices mentioned in clause 16, which form an integral part of the TOS.

2.2.

Upon acceptance of these TOS by the interested party, they automatically become part of each individual service contract with the Provider, by virtue of the acceptance of the interested party’s registration, which shall be considered valid only when duly completed.

2.3.

If these TOS or their appendices are unilaterally amended by the Provider, the User will be notified by email at least fifteen (15) days before the amendments come into effect.

2.4.

In the event described in the previous clause, the Client will always be granted the right to terminate his/her User registration before the amendments come into effect, except when there is an ongoing negotiation in which the User has participated.


3. USER SUPPORT SERVICE

3.1.

The User Support Service, called Bialto Help, is solely limited to assisting the User in situations where there is difficulty in using the Bialto.com Service. The Provider does not guarantee the provision of Bialto Help services in other areas, such as the configuration of specific software, the manner of using the software, or the utilization and exploitation of the potential of the Internet. The Provider also declares that it does not assume any obligation to provide consultancy services, particularly of a legal nature, nor to promote the resolution of any conflicts that may arise between Users in the context of commercial transactions carried out through the Bialto.com Service.

3.2.

The User Support Service is provided by offering the necessary instructions for the correct use of the Bialto.com Service via email.

3.3.

The purchase and sale contract between the Buyer and the Seller shall be considered concluded when the Buyer makes a winning bid in an auction or confirms his/her purchase through the Bialto.pt Service. The Provider is not a party to the purchase and sale contract but only facilitates its execution through the Bialto.pt Service. Once the contract between the Buyer and the Seller is concluded, both parties are responsible for fulfilling the agreed obligations, including the payment of the price and the delivery of the product or service.

3.4.

The instructions and information provided through Bialto Help are based on the data supplied by the User. Therefore, the assumptions on which such instructions or information are based may eventually prove to be incorrect, thereby exempting the Provider from any responsibility for the use that the User makes of such instructions or information.

When contacting via email regarding the use of the Bialto Help Service, it is mandatory to:

To use the Bialto Help Service, messages must be sent to one of the contacts provided by Bialto, unless otherwise indicated by the Bialto.com Support Team. All messages received by the User Support Service will be answered.


4. LEGITIMACY OF ACCESS TO THE SERVICE

4.1.

The Bialto.com Service cannot be used by persons who do not have full legal capacity to enter into binding contracts. In particular, it cannot be used by persons under the age of eighteen.

4.2.

The Provider does not assume any responsibility resulting from the lack of legal capacity of the Users to sell or purchase products or services.

4.3.

Interested parties in using the Bialto.com Service must inform the Provider of any situation that limits or excludes their legal capacity. If this does not occur, it is assumed that these interested parties have full legal capacity.

4.4.

Each interested party may only register once. The provider reserves the right to prevent multiple registrations and to delete any that are identified as such. Exceptions may be granted upon request, with Bialto.com deciding on the approval of multiple registrations on a case-by-case basis.

4.5.

To access the Bialto.com Service, the Provider will provide the User with a username and an access password (password), chosen by the User, according to the conditions established by the Provider that ensure the legitimacy and confidentiality of access. The User may later change these details according to the technical conditions disclosed by the Provider. Usernames composed of phone numbers, URLs, or email addresses will not be accepted by the Provider.

4.6.

The User agrees to keep the access password for the Bialto.com Service confidential and may not use a username or password to which he/she is not entitled. The User assumes full responsibility for any operations carried out using these details, even if they are performed by third parties, with or without his/her authorization, and for not disclosing his/her access password.


5. USER RESPONSIBILITY

5.1.

By using the Bialto.com Service, the User agrees not to engage in behavior that violates applicable law or harms legally protected interests or rights, and is further responsible for not disturbing or degrading the quality of the service. Among other things, the following actions are expressly prohibited:

The User agrees not to include, in the information disclosed via the Bialto.com Service, data that makes it difficult to control sales commissions or any unnecessary advertising information. Contacts such as email addresses, phone numbers, addresses, URLs, or any other data that enable direct contact between the Seller and the Buyer are not allowed.

5.3.

The User must follow all instructions provided by the Provider for the correct use of the Bialto.com Service, committing to act seriously by providing truthful and up-to-date information.

5.4.

Offers to buy or sell are irrevocable, except if:

The User assumes responsibility for any damages resulting from the alteration of information regarding the products or services, as mentioned in the previous item.

5.6.

Participation in auctions with speculative intentions, or any action intended to manipulate the price of the auctioned product or service—whether by purchase or sale offers or by inciting others to do the same—is not allowed. It is also forbidden to manipulate the auction process or influence the behavior of other Users.

5.7.

The User may not use automated programs or processes to monitor or reproduce, in whole or in part, the content of the Bialto.com Service pages.

5.8.

The User is responsible for placing products or services for auction and for the bids made, as well as for the information, messages, or content sent by him/her or by third parties using his/her identification data, ensuring that they are legal, truthful, and appropriate according to these Terms of Service (TOS).

5.9.

The User is responsible for completing the transactions conducted through the Bialto.com Service and for complying with the applicable law.

5.10.

If the User violates the Law or these Terms of Service, the Provider is under no obligation to act but reserves the right to intervene by suspending or canceling irregular auctions, blocking or removing inappropriate content, or restricting access to the Bialto.com Service.

5.11.

To enable the control of improper actions in the Bialto.com Service, the User agrees to participate in the Behavior Rating System (Feedback), as described in Clause 8 of the TOS.

5.12.

In the event of complaints from third parties or other Users regarding a User’s conduct in the Bialto.com Service, the Provider will inform the User by email, and the User assumes full responsibility and releases the Provider from any obligations or compensation claims.

5.13.

The value of the sale and purchase offers must always include the applicable VAT (Value Added Tax) for the transaction.

5.14.

Each User’s account is personal and non-transferable.

5.15.

The User agrees to provide the Provider, if requested within 90 days following the sale or the end of the auction, a copy of the payment receipt (for buyers) or the shipping proof (for sellers), except in cases where the delivery methods do not require such proofs.


6. SELLER RESPONSIBILITY

6.1.

The Seller further agrees to keep the Provider informed of all relevant aspects related to the products or services subject to the respective sale offer, to provide all necessary clarifications as requested, and to complete the corresponding transaction by delivering the goods or providing the auctioned services in accordance with the terms agreed with the Buyer.

6.3.

The Seller agrees to place the sale offers for products or services in the appropriate category.

6.4.

The Seller may include in the description of his/her Sale Offer only information related to the product or service being auctioned, as well as the conditions related to its transaction.

6.5.

The Seller is solely responsible for all content, including descriptions, images, and any other information posted on Bialto.com. The Seller warrants that the uploaded content does not infringe the rights of third parties, including, but not limited to, copyrights, trademarks, privacy rights, or any other applicable legal provisions. The publication of illegal, defamatory, fraudulent, misleading, offensive content or content promoting illegal activities is strictly prohibited. The Provider reserves the right to remove any content that violates these provisions or that, at its sole discretion, is deemed inappropriate for the platform, without prior notice to the Seller.

6.6.

Notwithstanding the foregoing, the Seller may include links in his/her Sale Offer, provided that they direct users to Internet pages that are limited to providing information about the characteristics of the products or services that may be disclosed in accordance with the TOS. The Provider disclaims any responsibility for damages resulting from accessing and using the content on the destination pages of such links. The Provider is completely uninvolved with the content provided on these pages and cannot ensure, in particular, its quality, legality, or reliability.

6.7.

The Seller declares that he/she possesses the necessary rights and authorizations required by law to participate in the Bialto.com Service in this capacity.

6.8.

The Seller agrees not to offer the items at a lower price than their actual value by compensating for this reduction with high shipping costs or by requiring the purchase of an additional item, in order to reduce the amount payable to the Provider as a sales commission.

6.9.

Whenever participating in auctions or multiple sales, the Seller agrees not to present more than 10 distinct sale offers simultaneously for identical or similar items.

6.10.

The Seller authorizes the Provider to freely use the content corresponding to the Sale Offer. The Provider will only use the information in accordance with the Privacy Policy.

6.11.

The Seller agrees not to present Sale Offers with selective options, that is, that imply an adaptation of the product to the tastes of the Buyer, except in the following cases: personalized services, such as card prints, or selections of measurements and color for products such as ring sizes, clothing, and accessories.

6.12.

The Seller agrees not to offer fixed or randomly determined prizes or offers as a purchase incentive.

6.13.

The Seller agrees not to present Sale Offers in the form of catalogs of items that may later be sold outside the Bialto.com Service.

SPECIAL CONDITIONS FOR PROFESSIONAL SELLERS

6.14.

Users who wish to act as professional sellers on the Bialto.com platform must indicate this status at the time of registration and provide the information required by the Provider, including, but not limited to:

Failure to comply with the above obligations may result in the suspension or termination of the professional seller’s account, without prejudice to any other sanctions provided by law or these Terms of Service.


7. BUYER RESPONSIBILITY

7.1.

The submission of a specific Sale Offer by a User implies the tacit acceptance of all sale conditions disclosed by the Seller and relating to the product or service, including the manner and place of delivery of the product or provision of the service and the potential obligation to pay additional expenses associated with the completion of the respective transaction, in addition to the bid amount in the case of an auction. These expenses include, but are not limited to, shipping costs and any applicable customs duties, which must be clearly specified by the Seller if applicable.

7.2.

If the User acts as a Buyer, he/she agrees to complete the corresponding transaction, receiving the goods or the provision of the auctioned services and paying the respective price and any other expenses charged to him/her, in accordance with the conditions clearly stated on the product page, unless the transaction is illegal or contrary to these TOS, in which case:

In an Auction Sale Offer, if the highest purchase bid is withdrawn by the Provider, as provided in clause 5.10, before the final date of the sale offer, the immediately lower bid shall be considered the highest bid, which must be accepted by the Seller, provided that the respective Buyer, after being notified by email of this fact, does not inform the Provider of the withdrawal of his/her bid.


8. BEHAVIOR RATING SYSTEM

8.1.

The User acknowledges that his/her participation as a Seller or Buyer in sales or auctions is subject to a behavior rating system, which aims to assess the seriousness and commitment demonstrated by the User during participation.

8.2.

The User’s rating, as mentioned in the previous clause, will be provided by the Sellers or Buyers who are the counterparties in the transactions in which the User participates.

8.3.

The behavior rating will be given by assigning one of the following scores: -1, 0, or 1, corresponding to:

The User will contribute to the operation of the behavior rating system by also assigning ratings, as provided in the previous clauses, to the counterparties in the transactions in which he/she participates.

8.5.

The User has the right to file an appeal or objection against any negative rating deemed unfair or incorrect. The appeal must be submitted to the Provider within 7 (seven) days after the rating is given, using the methods established on the platform. The Provider will review the case and make a final decision, which will be communicated to the User.

8.6.

The Provider reserves the right to temporarily suspend or permanently terminate the provision of the Bialto.com Service to the User, with the consequent termination of the respective Contract, if the User reaches a score of -2 or lower.

8.7.

The disclosure of the behavior rating scores assigned within the Bialto.com Service on any other electronic site is not permitted. The User further agrees not to assign these ratings based on information collected from other electronic sites.

8.8.

Without prejudice to the provisions of this clause, the Provider reserves the right to assign a negative rating to the User whenever it verifies non-compliance or defective performance by the User regarding the obligations assigned in connection with any participation in sales or purchase offers.

9. PROVIDER’S LIABILITY

9.1.

The Provider does not assume any responsibility for the fulfillment of the purchase and sale conditions agreed between the Seller and the Buyer, except in cases where the Provider’s liability is expressly provided for in these Terms of Service.

9.2.

The Provider shall not be liable for any damages resulting from service failures, maintenance operations, or any unforeseeable and insurmountable events beyond its control that prevent it, in whole or in part, from fulfilling the contractual obligations, or that result from non-performance, delay, or defective performance, except where such issues are attributable, either intentionally or through gross negligence, to the Provider or its representatives, agents, assistants, or any other persons employed to perform its obligations.

9.3.

The Provider is not obligated to monitor any activity or content transmitted during the use of the Bialto.com Service. However, the Provider reserves the right to conduct such monitoring within the applicable legal limitations and to take the necessary measures to cease any practice contrary to these Terms of Service or applicable law.

9.4.

The Provider shall not be liable for any error, failure, or inaccuracy related to the auction process, including but not limited to errors in bid allocation, transaction execution failures, or difficulties in delivering sold goods. The User acknowledges that it is solely responsible for ensuring the accuracy of the information provided during the auction or sale process. The Provider reserves the right to cancel or correct any transaction or auction in the event of an evident error, without incurring liability for any direct or indirect damages.

9.5.

Since the Provider is not obligated to monitor the content of data transmitted through the Bialto.com Service, it cannot be held liable for information, messages, content, correspondence, or any other data received by the User through this service, including descriptions and other information about the products or services for sale, even if such data may cause damage to equipment or support software or violate rights such as honor, dignity, and personal integrity or other legally protected rights, unless such liability arises from a mandatory legal provision.

9.6.

The Provider does not assume any responsibility for any violations of third-party rights, including copyrights on texts and images, that are inserted on the website www.bialto.com by Users. The responsibility for such violations lies solely with the User who inserted those contents.

9.7.

Due to the inherent difficulties in confirming the identity of Internet users, the Provider is not responsible for the correct identification of Users of the Bialto.com Service.

9.8.

The Provider does not assume responsibility for the accuracy and timeliness of the information provided by Users regarding the products or services for sale, the agreed delivery or performance deadlines, nor for the determination of the taxes applicable to the products/services, or their settlement, registration, and/or collection.

9.9.

The Provider does not assume any responsibility for the lack of authorizations or licenses, if the transaction is subject to licensing or any type of authorization or registration, which is the responsibility of the Seller or Buyer.

9.10.

In cases where the Provider acts as the Seller, it shall be responsible for the accuracy and timeliness of the information regarding the auctioned products or services, as well as for their delivery or performance after the sale.

9.11.

The Provider reserves the right to advertise purchase and sale offers through other channels, including the press and other communication media, whenever it deems necessary to promote the service.

9.12.

The User acknowledges that data circulating on the Internet is not protected against unauthorized access, use, or interception. The communication of usernames, access passwords, or any other confidential information is the sole responsibility of the User.

9.13.

The Provider shall not be liable, either directly or indirectly, for any direct or indirect damages, consequential losses, or lost profits incurred by third parties due to the non-performance or defective performance of the obligations assumed by the User, particularly with respect to these Terms of Service. The User agrees to defend or, if necessary, indemnify the Provider against any claims or demands by third parties arising from the User’s non-performance or defective performance of the obligations set forth herein.


10. PERSONAL DATA

10.1.

The Provider will collect and electronically process the User’s personal data by storing it in an appropriate database. The Provider is responsible for managing and protecting this data in accordance with the provisions of the applicable data protection legislation, including but not limited to Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation – GDPR).

10.2.

The Provider will communicate the contact details of the other party involved in the transaction to the User participating in a Sale or Auction Sale offer on Bialto.com, in order to complete the transaction initiated through the service.

10.3.

Without prejudice to the provisions of the previous clause, the participating User may request the contact details of his/her counterparty from the Provider by email within 30 days after the completion of the purchase/auction, subject to approval as provided under data protection laws.

10.4.

The Provider shall not be liable for any damages and/or losses resulting from the misuse by third parties of the data mentioned in this contract for purposes other than those established in the previous clause, regardless of whether the data was provided directly by the Provider or obtained by other means.

10.5.

The User agrees to provide correct, current, and complete personal data and to keep it in that state. If the personal data provided in the registration form is found to be incorrect or incomplete, the Provider may immediately suspend or terminate the provision of the Bialto.com Service and terminate the respective contract. The User acknowledges that providing false information may result in exclusion from the Service.

10.6.

The personal data provided by the User will be used to execute the contract as well as for the Provider’s information, marketing, and telemarketing activities, as regulated in the Provider’s Privacy Policy.

10.7.

The User expressly authorizes the Provider to use his/her personal data, the type of items purchased, and their respective value to create a personalized profile for the following purposes:

The User has the right to withdraw the authorization granted in the previous clause, as well as the right to consult, update, and correct his/her personal data through his/her online account or via User Support. Should there be any doubts regarding the accuracy of the data provided after an update, the Provider reserves the right to temporarily suspend the User’s registration until the matter is clarified.

10.9.

The User will acquire Certified User status when he/she meets all the necessary requirements, as specified in the Provider’s service terms and policies.

10.10.

The Provider undertakes to process the personal data of Users in accordance with the current data protection legislation, including the European Union’s General Data Protection Regulation (GDPR). The User expressly declares that he/she authorizes the Provider to process his/her personal data for the purposes described in these Terms of Service, including for the personalization of offers, communication of news, and execution of the contract. The User has the right to access, correct, delete, or restrict the processing of his/her personal data at any time as provided by applicable law. To exercise these rights, the User may contact the Provider using the contact methods provided by User Support.

10.11.

The User has the right to consult, update, correct, and delete his/her personal data at any time, in accordance with the provisions of the applicable data protection legislation, in particular the GDPR. The User also has the right to object to the processing of his/her personal data for marketing purposes under the applicable laws. To exercise these rights, the User must contact the Provider via User Support or through the contact details provided on the Bialto.com platform.

10.12.

All intellectual property rights related to the Bialto.com platform, including but not limited to trademarks, logos, designs, and copyright-protected content, belong to the Provider or its licensors. The User is not entitled to use any content from the Bialto.com platform except as expressly permitted in these Terms of Service. The Provider grants the User a limited, non-exclusive, non-transferable, and revocable license to use the Bialto.com platform solely for the purposes permitted by these Terms.


11. SHOPS

11.1.

The prices for the services provided by the Bialto.com shops, which are an integral part of these Terms of Service, can be found at: https://www.bialto.com/tarifario.

11.2.

To open a shop on Bialto.com, the User must demonstrate a favorable history of participation and performance in Bialto auctions. This history will be evaluated by the Provider based on internal criteria, including but not limited to the User’s behavior rating score as set forth in Clause 8.

11.3.

The Provider reserves the right to refuse the opening of a shop if the User does not meet the established requirements or does not have a participation history that meets the required criteria.

11.4.

The opening and operation of a shop is subject to acceptance of the current commercial and tariff conditions on the Bialto.com platform, which may be changed by the Provider with a 30-day notice to Users.

11.5.

The Provider is not responsible for any issues or losses arising from shop maintenance failures or activities carried out by the User within the shop, as the User is solely responsible for its content and operation.


12. TARIFFS AND PAYMENTS

12.1.

The Provider will make every effort to ensure the continuous availability of the Bialto.com Service. However, the User acknowledges that the Service may be temporarily suspended or interrupted for maintenance, updates, or other technical reasons. The Provider does not guarantee that the Service will be error-free, uninterrupted, or free from failures, nor will it be liable for any damage or loss resulting from the inability to access the Service during such periods.

12.2.

Access, registration, and posting of purchase offers on Bialto.com are free of charge.

12.3.

The prices for the services provided within the Auction Service, which are an integral part of these Terms of Service, can be found at: https://www.bialto.com/tarifario.

12.4.

Unless otherwise stated, all commission amounts are expressed in Euros.

12.5.

Promotional credits have a maximum validity of 12 months. The top-ups are non-refundable, are valid for 12 months from the date of top-up, and are intended for the payment of the Bialto.com Service. They will not be refunded under any circumstances, particularly in the event of contract termination as described in Chapter 13 of this document, or if the User discontinues the use of the service.

12.6.

Use of Images and User Uploaded Content

The User grants the Provider a non-exclusive, worldwide, irrevocable, royalty-free, and transferable license to use, reproduce, modify, adapt, publish, distribute, display, and sublicense the images and content uploaded by the User on Bialto.com for purposes related to the promotion and dissemination of the Bialto.com Service. The license granted by the User is valid as long as the content or image remains available on the Bialto.com Service or until the User removes the content. The User represents and warrants that he/she has all the necessary rights to grant the above-mentioned license and that the uploaded content or image does not infringe upon the intellectual property rights of third parties. The User may request the removal of his/her images or content at any time by submitting a request to User Support, without affecting the licenses previously granted.

The use of the images and content will cease from the moment the User submits a formal removal request; however, all images and content previously used by Bialto.com remain licensed and may continue to be used, including for marketing or promotional purposes, without any liability on the part of Bialto.com. If the Provider has modified or adapted the User’s images or content, the User shall have no rights to such modified versions.

If the Provider uses the User’s images or content on external platforms or for marketing purposes outside the context of the Bialto.com Service, the explicit consent of the User is required unless otherwise agreed in these Terms of Service.

12.7.

Bialto.com reserves the right to cancel or block the posting of purchase and sale offers on the Bialto.com platform.

12.8.

The amounts for Special Highlights are non-refundable and non-transferable under any circumstances.

12.9.

If the Provider offers an initial bonus, the credit may only be used for Special Highlights, such as highlights on the homepage, bold headlines, galleries, etc., which the User can benefit from free of charge. The initial credit is non-transferable and cannot be used as a form of payment for any services other than those described, nor can it be paid out to the User under any circumstances.


13. DURATION, SUSPENSION, AND TERMINATION

13.1.

The Provider may immediately terminate the Contract concluded with the User if the User violates any legal provision or any provision of these Terms of Service (TOS) or their attachments. Termination may also occur if fraudulent activity or connections to fraudulent activity promoted by the User in relation to the Bialto.com Service are detected by any means.

13.2.

The Provider reserves the right to temporarily or permanently suspend the User’s account in the following cases:

The Provider may make the continuation of the User’s account subject to its credit balance.

13.4.

In addition to other cases provided in the TOS, the Contract between the Provider and the User within the scope of the Bialto.com Service shall remain in effect until the User terminates it in one of the following ways:

The suspension or termination of the account does not release the User from his/her previous obligations, in particular:

Closure of Listings Due to Inactivity

The Provider reserves the right to automatically close product or service listings (including auctions and classifieds) associated with User accounts that do not log in to the Bialto.com platform for a period of more than 90 (ninety) consecutive days. This measure aims to ensure the currency of available offers and the reliability of the Service. The closure of offers does not imply the deletion of the account, which may be reactivated upon a new login.


14. NOTIFICATIONS

The User agrees to receive notifications related to the Bialto.com Service, including any changes to these Terms of Service (TOS), to the email address associated with his/her registration.


15. APPLICABLE LAW AND JURISDICTION

15.1.

For all matters not expressly regulated in these TOS, Portuguese law shall apply. In the event of any dispute arising between the Provider and the User regarding the interpretation or application of these TOS, both parties agree that such dispute shall be subject to the exclusive jurisdiction of the District Court of Lisbon or the District Court of Porto, with explicit waiver of any other jurisdiction.

15.2. Disclaimer

The Provider shall not be liable for any technical failures, service interruptions, system errors, or other problems related to the Bialto.com platform. Furthermore, the Provider assumes no liability for any damage, loss, or impairment that the User may suffer as a result of using the Bialto.com Service, including but not limited to failed transactions, disputes between Users, and damages arising from content published by third parties on the platform. The User is solely responsible for his/her actions and for the offers, transactions, and information provided in connection with the Bialto.com Service.

15.3. Amendments to the Terms of Service

The Provider reserves the right to change these Terms of Service at any time. Such changes will be communicated to Users via notification to the email address associated with their registration or by other appropriate means. The User agrees that continued use of the Bialto.com Service after notification of any changes constitutes acceptance of the new terms.
